Litigation Practice Area
John McQuiston is an experienced commercial litigator and is general counsel to two e-commerce companies. He has been named as one of the top 100 lawyers in Tennessee, one of the top 50 lawyers in the three-state Mid-South region, and one of the 15 best business litigators in Memphis. He is listed in the prestigious publication Best Lawyers in America for commercial litigation. His experience includes a broad range of issues including but not limited to:
- Breach of contract
- Construction
- Securities fraud
- Antitrust
- Directors' and officers' liability
- Breach of fiduciary duties
- Taxation disputes
He graduated from Rhodes College in 1965, U.S. Naval Justice School in 1969 with honors, and Vanderbilt University (J.D.) in 1968. He has gone on to successfully argue cases in the U.S. Supreme Court, the Tennessee Supreme Court, and in state and federal Courts of Appeals. See, e.g., Allenberg Cotton Company v. Pittman, 419 U.S. 20; Howard v. Olsen, 675 S.W. 2d 154, and HMF Trust v. Bankers Trust Company, 827 S.W. 2d 296.
Mr. McQuiston is a mediator for the Financial Industry Regulatory Authority (FINRA). He is a former director of the Memphis Bar Association and former chairman of the Tennessee Bar Section on Antitrust and Business Torts. He also cowrote the books Conducting International Business Transactions in the U.S. and Foreign Countries (NBI), Technology Law in Tennessee: An Advanced Approach (NBI), Tennessee Construction Law (NBI), and Legal Issues for Engineers (2008). Mr. McQuiston is past chairman of the Board of St. Mary's Episcopal School.
